Boss Events & Travel (“Boss” or ” we”) is an event planning and travel advisory consulting firm located in Texas. The following terms and conditions apply to users of this website, hereinafter referred to as “you” or “user.”
IT IS IMPORTANT THAT YOU READ THE TERMS AND CONDITIONS OF THIS AGREEMENT CAREFULLY BEFORE USING BOSS’S WEBSITE AS THIS AGREEMENT PUTS FORTH LEGALLY BINDING TERMS AND CONDITIONS OF THE WEBSITE WWW.BOSSEVENTSANDTRAVEL.COM AND/OR ANY MOBILE APPLICATIONS AND ALSO CONTAINS INFORMATION REGARDING YOUR LEGAL RIGHTS IN USING THE WEBSITE.
User. These terms and conditions apply to any person contacting Boss or requesting a quote through Boss’s website and to all other person(s) on whose behalf contact or a request for a quote is being made. You represent and warrant that you are at least eighteen (18) years old and are of legal capacity to consent to the terms and conditions of this agreement.
Consent by User. You are being granted a right to use this website in order to connect with a Boss advisor. By using this website, you agree to adhere to the terms and conditions stipulated under this agreement and to be legally bound to said terms and conditions. You also agree that you have completely acknowledged, read, understood, and consent to these terms and conditions.
Services and Service Fees.
(a) Boss offers travel advising and event planning services. We arrange and sell custom travel and travel-related services, packages, and products on behalf of third-party providers of air, land, and sea travel, including airlines, cruise, rail, bus, tour, and transportation operators, and lodging and accommodations.
(b) Boss may charge a service fee on your booking at its discretion. All service fees will be disclosed to you prior to booking. You agree to pay this service fee in exchange for Boss’s travel advising and concierge services.
No Warranty or Representation. Boss will use its best efforts to arrange the best custom travel package deal for you; however, we make no representation nor offer a warranty regarding services, packages, or products you purchase from the chosen third¬-party providers. Your booking(s) will be subject to the terms and conditions of the third party that is providing the services, packages, or products. You agree that if the travel and travel-related services, packages, or products do not conform with the terms and conditions of the third-party provider agreements, that your dispute and remedy must be with the actual third-party provider of the service, package or product and not with Boss.
Third Party Provider(s).
(a) By using this website, you are aware that we use third-party providers to book event venues, travel, and travel-related services, packages, and products. Boss does not represent that we are agents or affiliates of all possible third-party providers; however, we will use our best efforts to book the best custom travel and travel-related service, package, or product for you.
(b) When Boss receives either a deposit or full payment for a travel service, package, or product, we shall confirm receipt of such deposit or payment and facilitate booking with the third-party provider(s). Agreements with terms and conditions will then exist between you and the third-party provider(s) at the time of engagement with said third-party provider(s) and those terms and conditions shall govern your travel service, package, or product. It shall be the sole responsibility of the chosen third-party provider(s), and not Boss, to provide you with the travel and travel related service, package or product.
(c) Copies of the agreements with terms and conditions of third-party provider(s) shall be available upon request by user. It is the sole responsibility of the user making the booking to provide, and that user must provide, a copy of the terms and conditions with third-party provider(s) to the other members of the travel party.
Consent to Share Information with Third Party Providers. By providing personal information and financial information to Boss, you also consent to your information being shared with chosen third-party providers of travel and travel-related services for the sole, exclusive, and limited purpose of booking services, packages, or products with those third-party providers. Even though Boss processes your booking by sharing your information to third¬-party providers, we commit to taking all reasonable precautions to ensure that your data is protected and that your information is secured.
Force Majeure and Travel Insurance.
(a) You agree that Boss will not be liable for any losses or damages incurred by you as a result of Boss or any third-party provider not being able to perform its obligations or a delay in performing its obligations under the contracts between you and the third-party providers due to unforeseeable circumstances and/or force majeure events which are beyond the control of the third-party provider. A force majeure event includes, but is not limited to, acts of God, earthquakes, fires, floods, wars, civil or military disturbances, acts of terrorism, sabotage, strikes, epidemics, pandemics, riots, power failures, loss or malfunction of utility, accidents, labor disputes, acts of civil or military authority, or governmental actions.
(b) Boss strongly recommends that you purchase a comprehensive travel insurance policy which may provide coverage for loss of your payment deposit, delay or cancellation of your travel, and/or additional expenses, medical expenses and loss of baggage and personal property.
Prices and Changes.
(a) Boss shall use its best efforts to quote you the most accurate prices for travel and/or travel related services, packages or products based on information provided to us from third-party providers. If there is a price change made prior to booking for which Boss is aware, we will bring it to your attention prior to booking and paying your balance. You should be aware that our third-party providers do reserve the right to increase their prices due to increases in airfares, accommodations and sometimes currency fluctuations.
(b) You should be aware that if you want to make changes to your booking Boss will make best efforts to assist you and to facilitate those changes; however, the ultimate decision is that of the third-party providers you use and they are under no obligation to make any requested changes.
Cancellations and Refunds.
(a) If you choose to cancel your booking you may incur cancellation charges which will be stated in the agreements between you and the travel third¬ party provider of the service, package or product. It will also be the discretion of Boss to charge you a fee for cancellations.
(b) If you are entitled to a refund, please note that Boss will only be able to issue you a refund if and when it first receives the refunded funds from the third-party provider and direct issuer of the refund.
NOTE: Some suppliers have 48-hour refundable cancellation policies based on their services. Please ensure you are aware of all pertinent cancellation policies prior to your bookings.
Travel Document Obligations. Where applicable, you are solely and completely responsible for having valid travel documents at the time of travel. Such travel documents include, but are not limited to, passports, residency cards, visas and entry permits. It is our strong recommendation of Boss that you research and be aware of any applicable laws of the regions, territories or countries in which you are visiting and your obligations to act accordingly with those laws.
Limitation of Liability.
(a) Boss shall have no liability regarding any aspect of your booking including any liability for illness, personal injury, death or loss of any kind, delay and inconvenience caused either directly or indirectly by any third-party provider of travel or travel related services, packages or products or by any other third parties unless caused by our negligence. All claims for damages for injury, illness, loss or death must be brought directly against the appropriate third-party provider.
(b) You also agree that Boss is not liable for any damages arising from or related to any airline time changes, cancellations, delays, missed connections, mechanical issues, inclement weather, lost or delayed baggage, or refusals for boarding nor your failure to properly check in for flights.
Indemnification. You agree to defend, indemnify, and hold harmless Boss and all its affiliates, members, officers, and agents, from and against all claims, demands, liabilities, costs, losses, and expenses, including reasonable attorneys’ fees, arising from your use of this website or your breach of this agreement. We may elect to assume the defense and control of such claim and, in such case, you agree to cooperate with us in the defense of such claim and to reimburse us for all reasonable expenses and fees incurred while defending such claim.
Modifications and Additional Terms and Conditions.
(a) BOSS RESERVES THE RIGHT TO ALTER THES E TERMS AND CONDITIONS OF THIS AGREEMENT FROM TIME TO TIME, WITH OR WITHOUT NOTICE TO YOU AND AT OUR SOLE DISCRETION, AND YOUR CONTINUED USE OF THE WEBSITE OR ANY SERVICES AFTER SUCH CHANGES TO THIS AGREEMENT HAVE BEEN POSTED CONSTITUTES ACCEPTANCE OF ALL SUCH CHANGES. IT IS YOUR RESPONSIBILITY TO REGULARLY REVIEW THIS AGREEMENT WHEN USING THE WEBSITE OR OUR SERVICES.
(b) If Boss makes a material change to the terms and conditions of this agreement, we will notify you of such a change by posting the change to this website. We will also determine what constitutes a material change based on our sole discretion, reasonable judgment this will be done in good faith.
Termination. You may terminate this agreement prior to any bookings being made with third-party providers. You may still be required to pay any service fees owned to Boss for services rendered. Some obligations under this agreement may still be applicable to you even after termination of this agreement.
Notices. You may contact our company by emailing us or sending mail to 17119 Red Oak Drive Unit 73711, Houston, Texas 77273. We hope that you are satisfied with your travel, but if you have any complaints or are unsatisfied with your experience, contact your third-party provider immediately. Boss will make best efforts to work with you to resolve your matter with third parties but makes not guarantees of success in resolving your matter amicably.
Governing Law and Venue. This agreement shall be construed, and jurisdiction shall be according to the laws of the State of Texas. Venue for any disputes arising under this agreement shall be in Harris County, Texas.
Arbitration. All disputes arising out of or relating to this agreement, including but not limited to breach, termination, defenses or validity of this agreement, shall be submitted to binding arbitration. We agree with you to consult and negotiate and attempt to reach a satisfactory solution. If we do not reach a settlement within a period of thirty (30) calendar days, then we will provide you with written notice that all unresolved controversies or claims shall be settled by arbitration administered by the American Arbitration Association held in Harris County, Texas.
Severability. If any section, article or clause, or any other portion of this agreement shall be determined to be void or unenforceable for any reason, such determination shall not affect the validity or enforceability of any other clause or portion of this agreement, all of which shall remain in full force and effect.
Representation and Acceptance. You agree and mutually warrant that we have full power and authority to enter into this agreement and to perform our contractually obligations.
Integration. There are no other verbal or other agreements which modify or affect the terms and conditions of this agreement. This agreement constitutes the complete agreement between you and Boss and incorporates all prior discussions, agreements, representations and warranties, express or implied, oral or written, with respect to the contents of this agreement.
Fee Schedule. Boss’s fee schedule is as follows:
